Non-married couples can adopt, but in some states (like mine) gay couples can't. It just won't be declared a fit home. I remember a case when I was in high school: A man and a woman got a divorce. The man was an unemployed alcoholic with a tendancy to knock his wife and their kid around when he was drunk; the wife was a sober woman with a good job, but happened to fall in love with another woman either at the end of the marriage or shortly after the divorce. The courts removed the child from the mother's home and gave him to his dad, because they didn't feel a lesbian would make a suitable parent for a young boy.
